Terms of Service

Welcome to EternalFrame. These Terms of Service ("Terms") govern your access to and use of the EternalFrame mobile application and related services (collectively, the "Service") operated by EternalFrame ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
EternalFrame is a mobile application that uses artificial intelligence to transform photographs into styled portraits, including memorial portraits, colorized family photos, and other artistic styles. The Service includes both free and paid tiers, with features such as AI-powered photo transformation, multiple style presets, and high-resolution output.
2. Account Registration
- You must provide accurate and complete information when creating your account.
- You are solely responsible for maintaining the security of your account credentials.
- You must be at least 13 years of age to use the Service.
- Each individual may maintain only one account. Creating multiple accounts to abuse free-tier benefits is prohibited.
- You agree to notify us immediately of any unauthorized use of your account.
3. Credits and Payments
- Credits are the in-app currency used to purchase photo transformations.
- Credits are purchased through the Apple App Store or Google Play Store and are subject to the respective store's terms and pricing.
- Credits are non-refundable except as required by applicable law or the refund policies of Apple or Google.
- Purchased credit packs do not expire.
- Monthly subscription credits refresh at the beginning of each billing cycle. Unused subscription credits do not carry over to the next cycle.
- The free tier includes 2 watermarked transformations to allow you to evaluate the Service before purchasing.
- We reserve the right to adjust pricing with at least 30 days advance notice. Price changes do not affect credits already purchased.
4. Acceptable Use
You agree to use the Service responsibly and in accordance with the following guidelines:
- You must have the legal right to upload any photo you submit. This includes photos you have taken yourself or photos for which you have obtained explicit permission from the rights holder.
- You must not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- You must not upload content that depicts or exploits minors in any way.
- You must not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application or its AI processing pipeline.
- You must not use the Service to create deepfakes, impersonate others, or generate deceptive or misleading content intended to deceive third parties.
- You must not attempt to circumvent usage limits, manipulate the credit system, or exploit vulnerabilities in the Service.
- You must not use automated tools, bots, or scripts to access or interact with the Service.
We reserve the right to suspend or terminate accounts that violate these guidelines, with or without prior notice, depending on the severity of the violation.
5. Intellectual Property
- Your photos: You retain all ownership rights to the original photos you upload to the Service.
- Transformed outputs: You own the transformed portraits generated by the Service. You may use, share, print, and distribute them freely.
- Our property: EternalFrame retains all rights to the application, its design, style presets, AI processing pipeline, branding, and all underlying technology.
- We do not claim any ownership of your photos or transformed results. We do not use your content for marketing without your explicit, separate consent.
6. AI-Generated Content
Transformation results are generated by artificial intelligence and may vary in quality, accuracy, and likeness. We strive for the highest quality but cannot guarantee specific outcomes for every photo.
- Results depend on input photo quality, lighting, resolution, and other factors.
- Credits are only consumed upon successful completion of a transformation. If a transformation fails due to a system error, your credits are automatically refunded.
- If a face cannot be detected in your photo, the transformation will not proceed and no credit will be charged.
7. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.
- Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.
- We are not responsible for emotional distress or other subjective harm related to AI-generated results. We understand the deeply personal nature of memorial portraits and encourage users to review results before sharing or printing.
8. Indemnification
You agree to indemnify, defend, and hold harmless EternalFrame, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
9. Termination
- You may delete your account at any time through the Settings screen in the app.
- We may suspend or terminate your access to the Service if you violate these Terms, engage in fraud, or for any other reason at our discretion with reasonable notice.
- Upon account deletion or termination, your personal data and photos will be permanently deleted within 30 days.
- Unused credits are forfeited upon account termination, except where prohibited by applicable law.
10. Dispute Resolution
In the event of any dispute arising from these Terms or your use of the Service, you agree to first attempt to resolve the dispute informally by contacting us at eternalframe-support@huybuilds.app. If informal resolution is not possible within 30 days, any remaining dispute shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property matters.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in the state or federal courts located in San Francisco County, California.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through an in-app notification at least 14 days before the updated Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
